Division of Community Property in Arizona

As a community property state, Arizona defines all property acquired during a marriage as community property. The exceptions to this rule include property acquired by gift to one of the parties, property received through an inheritance, or property and assets acquired after the filing of divorce or separation papers. Only these types of property, as well as property acquired by one party before the marriage, are considered to be sole and separate property. Although the Arizona law on the division of property sounds straightforward, there are many issues that arise during the process of property division--issues that almost always need to be resolved by an experienced and knowledgeable attorney.

Community Property Issues During Divorce

The issues related to dividing community property during divorce can be complex. Some of these include:

  • Separate property that has become co-mingled
  • Assets hidden by one party to protect them from division under community property laws
  • Disagreements between the parties over the value of property
  • Business interests in other states

Our attorneys work on these and all issues related to property division by employing experts such as forensic accountants. These specialists determine when an asset was acquired, whether one party is concealing property that should be community property, or whether co-mingled assets are really sole and separate property. In addition to working with experts, our attorneys do not hesitate to litigate. If necessary, we will cross-examine the other party under oath to learn whether all community property has been fully disclosed. Our attorneys are known for their willingness to undertake difficult investigations to insure equitable distribution of property. We use our substantial business experience and contacts with appropriate experts to resolve matters related to the division of property during divorce.
